Well from a common sensical view, maybe. But in terms of legal precedent, there isn't much to go on. Which is why the decision from this case will have such an impact on the writing community as a whole.

He wasn't crafty enough though - Jo & WB could still sue for indirect damages and RDR could sue for breach of contract. If it goes in the favour of Jo & RDR.

I used to read and like the Harry Potter lexicon, untill all of this business came about. Now I've boycotted it!!! JK's got to win this, we're supporting her all the way. I think the trial should have been held in Britain, though - why should JK have had to travel to America? Surely RDR and their minions should have to pay the airfare to come to Britain for the courts, because they're in the wrong as far as I'm concerned.
