Destiny wasn't spying per se, she was simply observing.

She just so happened to be in the dungeons because, well, her common room was down there and she had just come back from finding her pet rat, Marcus. How was she supposed to know that the rat kept getting out of her pocket because there was a hole in it? Wasn't that the house elves job? To fix people's holes!? Next time she went to the kitchen, she would have a few words with them.

As she was making her way back to her common room, because after all her searching she needed chocolate, Destiny stopped in her tracks when she heard voices. Usually no one was down in the dungeons, so when there just so happened to be people, she liked to spy on observe them. Especially when those people weren't Slytherin.
