Well first off, McGonagall could have mistaken it for transfiguration when it was really just him being forced into his animagi form. She wouldn't've been able to tell.. And about Moody telling on Draco.. the REAL Moody hates the Malfoys but remember that wasn't the real Moody..

And I think there is some evidence.. you just have to read between the lines a little. Draco seems to spy on Harry a lot, (ex. Watching him when he visited Hagrid and seeing Norbert in SS) And changing into a ferret would definately help him sneak around more..
