Not always. If the Prosecuter won't make a deal, you might as well just plead Not Guilty. Besides, just cos he had it doesnt mean he stole it. Someone could have stolen it, given it to him, and then he tried to sell it. Yes, he'd have to KNOW it was stolen, and he could be charged with possession of stolen property, but a family member could have actually stolen it.
